On June 16th, the Vietnamese National Assembly passed a law amending and supplementing a number of Articles of Law on Intellectual Property (the amended IP Law). Accordingly, the amended IP Law will take effect on January 1st, 2023, except for the regulations on the sound marks protection and agricultural chemical test data, which will take effect respectively on January 14th, 2022, and January 14th, 2024, to comply with obligations outlined in the CPTPP Agreement. Since its 17-year implementation, the Law has been amended for the third time. While the first amendment was in 2009, the latest one was in 2019. The amendments and supplements in 2022 are the most comprehensive revision, with over 100 Articles being amended and supplemented. The amended IP Law is promulgated to solve pragmatic shortcomings throughout the 17 years of its implementation and ensure compliance with IP-related commitments in the FTAs that Vietnam participates in, especially the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) and the European Union – Vietnam Free Trade Agreement (EVFTA). Correspondingly, the amended IP Law covers related matters, including definitions amendments and supplements; additions to the state's policies on intellectual property rights; IP subject matters amendments and supplements; IP representation activity; IP assessment, and regulations on IP enforcement. With the above amendments and supplements, it is hoped that Intellectual Property Law will overcome its shortcomings to meet the requirements outlined in Vietnam's economic and social development. Additionally, to create a strong driving force for research and innovation and guarantee an adequate and effective legal framework to protect, exploit and enforce IP rights in Vietnam, as well as a full guarantee of compliance with Vietnam’s international agreements, thus ensuring a more globalized economy.
